Terms of Service.

1. Acceptance

By creating an account or using the Alfacotex application, website, or any related service (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Asfire, Inc. ("Asfire," "we," "us"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old and capable of forming a binding contract to use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@alfacotex.com if you suspect unauthorized access to your account.

4. The Service

Alfacotex provides autonomous digital forensics and incident response (DFIR) capabilities. The Service allows you to:

• Install a local agent on supported operating systems.
• Run on-demand forensic scans at varying depths (Standard, Medium, Deep).
• Receive AI-generated forensic reports mapped to the MITRE ATT&CK framework.
• Subscribe to continuous monitoring for real-time threat detection.

5. Scan credits and subscriptions

The Service uses a credit-based model for on-demand scans and a subscription model for continuous monitoring.

• Credits. Scan credits are purchased in packs and do not expire. Credits are non-transferable and non-refundable, except as required by law.
• Subscriptions. Monitor subscriptions are billed monthly or annually. You may cancel at any time. Cancellation takes effect at the end of the current billing period. Annual subscriptions are eligible for a full refund within the first 14 days.
• Pricing changes. We may change pricing with at least 30 days notice. Price changes do not apply to credits already purchased or active subscription periods already paid.

6. Acceptable use

You agree not to:

• Use the Service to scan devices you do not own or have explicit authorization to scan.
• Reverse-engineer, decompile, or disassemble the agent software or any part of the Service.
• Attempt to circumvent usage limits, credit balances, or authentication controls.
• Use the Service for any unlawful purpose or in violation of any applicable regulations.
• Resell, sublicense, or redistribute the Service or generated reports without prior written consent.

7. Intellectual property

Asfire retains all rights, title, and interest in the Service, including its software, algorithms, models, designs, and documentation. Forensic reports generated from your scans are yours. You grant us a limited license to process your scan data solely to provide and improve the Service.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, whether express, implied, or statutory. We do not warrant that the Service will detect all threats, that scan results will be error-free, or that the Service will be uninterrupted. Alfacotex is a forensic analysis tool, not a replacement for professional incident response services. Critical security incidents should be escalated to qualified professionals.

9. Limitation of liability

To the maximum extent permitted by law, Asfire shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability is limited to the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold Asfire harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your scanning of devices without proper authorization.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. You may close your account at any time. Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited unless a refund is required by applicable law.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

13. Changes to these terms

We may modify these Terms at any time. Material changes will be communicated via email or a notice in the Service at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
